Zwischen Bosnien und Herzegowina und \u00d6sterreich sowie zwischen Serbien und \u00d6sterreich besteht die sogenannte <strong>Gegenseitigkeit<\/strong>. Das bedeutet: Da Staatsb\u00fcrger aus Bosnien und Herzegowina sowie Serbien Immobilien in \u00d6sterreich erwerben k\u00f6nnen, haben \u00f6sterreichische Staatsb\u00fcrger das gleiche Recht in den genannten Staaten. Ein Kind kann, obwohl es die \u00f6sterreichische Staatsb\u00fcrgerschaft besitzt, als Eigent\u00fcmer einer Immobilie in Bosnien und Herzegowina sowie Serbien eingetragen werden.<\/p>\n\n\n\n<p><strong>Schenkungssteuer: Wer ist von der Zahlung befreit?<\/strong><\/p>\n\n\n\n<p>Die gr\u00f6\u00dfte Unsicherheit betrifft meist die Immobilien\u00fcbertragungssteuer. Die gute Nachricht ist, dass <strong>Kinder vollst\u00e4ndig von der Steuerzahlung befreit sind, wenn sie eine Immobilie von ihren Eltern<\/strong> als Schenkung erhalten.<\/p>\n\n\n\n<p>Diese Befreiung basiert auf dem Verwandtschaftsverh\u00e4ltnis, dem ersten Erbrang, und ist unabh\u00e4ngig von der Staatsb\u00fcrgerschaft. Ein Kind, das die \u00f6sterreichische Staatsb\u00fcrgerschaft besitzt, wird somit genauso behandelt wie Staatsb\u00fcrger von Bosnien und Herzegowina beziehungsweise Serbien.<\/p>\n\n\n\n<p><strong>Welche Unterlagen werden ben\u00f6tigt?<\/strong><\/p>\n\n\n\n<p>In den meisten F\u00e4llen gen\u00fcgen die Geburtsurkunde des Kindes, die Personalausweise, der Reisepass und ein Grundbuchauszug f\u00fcr die zu verschenkende Immobilie. Nat\u00fcrlich ist es notwendig, vor der Anreise die genaue Liste der Dokumente detailliert mit einem Notar oder einem Rechtsanwalt abzugleichen.<\/p>\n\n\n\n<p><strong>Das Verfahren in 4 Schritten:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Erstellung des Schenkungsvertrags:<\/strong> Bei einem Rechtsanwalt mit anschlie\u00dfender Beglaubigung oder direkt bei einem Notar.<\/li>\n\n\n\n<li><strong>Anmeldung beim Finanzamt:<\/strong> Es muss eine Meldung bei der zust\u00e4ndigen Steuerbeh\u00f6rde eingereicht werden, um den Bescheid \u00fcber die Steuerbefreiung zu erhalten.<\/li>\n\n\n\n<li><strong>Eintragung des Eigentumsrechts im Grundbuch:<\/strong> Einreichung des Antrags auf Eintragung des Eigentumsrechts beim Grundbuchamt unter Entrichtung der Geb\u00fchr.<\/li>\n\n\n\n<li><strong>Kataster:<\/strong> \u00c4nderung des Besitzers im Kataster.<\/li>\n<\/ol>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-medium-font-size\"><em>mr. iur.
